Tscheck Terms Of Use

The following terms and conditions govern all access to and use of tscheck (hereinafter also referred to as the "Service") is owned and operated by denkwerk GmbH (hereinafter also referred to as "denkwerk", "we", "our" or "us"). tscheck is offered on the condition that you accept the terms and conditions contained herein and any other operating rules, policies and procedures that may be posted from time to time (collectively referred to as the "Agreement").

By accessing tscheck, you agree to be bound by the terms of the Agreement. If you do not agree to all the terms and conditions of the Agreement, you may not access or use tscheck.

  • Description of tscheck: tscheck offers users the opportunity to post inspiring questions in a slack channel via the command "/tscheck". With questions such as "What was your highlight of the day?", "What is your energy level?", "What has your attention?", team sessions can be started or completed to strengthen team alignment and bonding. Whether daily, conference call, project retro or brainstorming sessions - with Tscheck, teamwork becomes more collaborative, inspiring and, not least, more efficient. Furthermore, Tscheck can be accessed and used via Tscheck.ai. The connection with OpenAI creates even better Tschecks through the integration of artificial intelligence.

  • No connection with Slack: denkwerk and Slack Technologies Inc, the provider of the Slack communication service, ("Slack") are different entities. There is no relationship between denkwerk and Slack, except that denkwerk is licensee and user of the Slack API for the purpose of providing tscheck. Slack is not responsible for tscheck and does not provide support for tscheck. These terms do not apply to the use of the Slack service. Such use is governed by the Slack Terms of Use available on the slack.com website.

  • Your personal data: Please see our privacy policy

  • Your tscheck account: You are fully responsible for all activities that take place under your tscheck account and for all other actions that are performed by you or other users in connection with that account. You are obliged to inform tscheck immediately of any unauthorised use and users of your tscheck account or any other breach of security. denkwerk shall not be liable for any acts or omissions on your part, including any damages of any kind arising from such acts or omissions.

  • Intellectual property: We are the owner of all intellectual property rights in tscheck. We grant you: a limited, non-exclusive, revocable permission to use tscheck. Your use of tscheck does not grant you any right to reproduce or otherwise use the trademarks, service marks, trade names, logos, domain names or other features of the tscheck trademark, either for commercial or non-commercial purposes.

  • Changes: We reserve the right to change the agreement at any time and for any reason. Any changes we may make to the Agreement in the future will be notified to you by posting an updated version of the Agreement on this page. Your continued use of or access to tscheck after the changes to the Agreement constitutes your acceptance of those changes.

  • Termination: tscheck may terminate the Agreement and suspend your access to the Service immediately.

  • Disclaimer of warranties: tscheck hereby disclaims all warranties of any kind, whether express, implied, statutory or otherwise.

  • General representation and warranty: You represent and warrant that your use of tscheck is in strict accordance with the Agreement. In particular, you represent and warrant that:

    • You will comply with Slack's terms of use at all times.

    • You will not use tscheck in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with the Agreement, or act fraudulently or maliciously, such as by hacking into tscheck or inserting malicious code, including viruses or harmful data, into tscheck.

    • You will not infringe our intellectual property rights or the rights of third parties in relation to your use of tscheck.

    • You will not use tscheck in any way that could damage, disable, overload, impair or compromise our systems or security or interfere with other users.

    • You will not collect or harvest any information or data from any Content or our systems or attempt to decipher transmissions to or from the servers running tscheck.

  • Indemnification: You agree to indemnify and hold harmless denkwerk from and against all claims and costs, including legal fees, arising from your use of tscheck, including but not limited to your breach of this agreement, which may be contrary to this agreement.

  • Law and jurisdiction: The agreement is subject to German law. All disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the courts of the Federal Republic of Germany.

  • Miscellaneous: This Agreement constitutes the entire agreement between denkwerk and you with respect to the provision of the tscheck. The agreement is concluded between you and us. It is not intended to grant any rights, including the right to enforce any of its terms, to any other person. Failure or delay on our part to enforce the Agreement or any of its terms does not constitute a waiver of our right to do so. We may assign our rights and obligations under the Agreement to a third party, but this shall not affect your rights under the Agreement. Each of the terms and conditions of the Agreement applies separately. If a court or competent authority decides that any of them is unlawful or unenforceable, the remaining terms and conditions shall remain in full force and effect and shall be interpreted, so far as possible, to give effect to the parties' intentions as originally expressed in the Agreement.

Since October 2023 the service Tscheck of denkwerk GmbH interacts with the interface of OpenAI to work with the service "Chat GPT". With the help of ChatGPT, even better Tschecks are generated.

The above terms of use apply
Correspondingly also for the case that Tscheck is used via the website and thus in connection with OpenAI (ChatGPT). However, some exceptions apply (details can be found at: https://openai.com/policies/terms-of-use).
Essentially, this means that OpenAI reserves the right to use your input (prompts) and the resulting output as well. Therefore, OpenAI grants you a non-exclusive, but temporally and spatially unlimited and commercially usable right to use the Outputs.
